Terms of Use

1. Acceptance of these terms

These Terms of Use (“Terms”) form an agreement between you and Shenzhen Guanxin Zhilian Technology Co., Ltd. (“Tymate”, “we”, “us” or “our”) and govern your use of the Tymate TPMS application and this website (together, the “Service”).

By downloading, installing or using the App, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

2. About the App and your licence

Tymate TPMS is a Bluetooth tire pressure monitoring application that displays pressure and temperature readings from compatible Tymate tire sensors, and alerts you when readings pass the thresholds you configure.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the App on devices that you own or control, for your personal, non-commercial use. This licence does not transfer ownership of the App or of any content in it.

3. Safety notice

• Check tire pressure with a reliable gauge before a trip and follow the pressure values specified by your vehicle manufacturer.
• Inspect tires regularly for damage, wear and leaks. A sensor cannot detect every fault.
• Do not interact with the App while driving or riding. Set up the App and adjust settings only when safely parked.
• Readings may be delayed, unavailable or inaccurate because of sensor failure, low sensor battery, radio interference, distance, device restrictions or other causes.
• Never rely on the App as the sole source for a decision that affects your safety or the safety of others.

You remain responsible for the safe operation and maintenance of your vehicle.

4. Permitted use

You agree not to:

• Copy, modify, distribute, sell, sublicense, rent or lease the App or any part of it
• Reverse engineer, decompile or disassemble the App, except where applicable law expressly permits it
• Remove or alter any copyright, trademark or other proprietary notice
• Use the App in a way that interferes with its operation or with other users' devices
• Use the App for unlawful purposes or in breach of applicable regulations
• Use the App with sensors or equipment that are not compatible, or in a way that could damage your vehicle

5. Intellectual property

The App, this website and their content — including the Tymate name, logo, interface design, graphics and text — are owned by Tymate or used under licence and are protected by intellectual-property laws. No rights are granted to you other than the limited licence described in these Terms.

Vehicle and app-store names, logos and trademarks mentioned in the Service belong to their respective owners.

6. App stores and third-party links

You may download the App through the Apple App Store or Google Play. Your use of those stores is governed by their own terms and privacy policies. If these Terms conflict with the store's terms for your download or use of the App, the store's terms prevail to the extent of the conflict.

This website may link to app-store pages or other third-party sites. We are not responsible for their content, availability or practices.

7. Availability and updates

We may release updates, change features, or discontinue the App or parts of it. Updates may be required for security, compatibility or regulatory reasons. We do not guarantee that the App will work with every device, operating-system version or sensor model, or that it will always be available without interruption.

Any purchase or subscription offered through an app store is handled by that store. Refunds are governed by the store's policies and applicable law.

8. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App and this website are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that readings will always be accurate, complete, timely or uninterrupted, or that the App will detect every tire condition. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you.

9. Limitation of liability

To the maximum extent permitted by applicable law, Tymate will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, use or goodwill, arising out of or related to your use of or inability to use the Service.

To the same extent, our total aggregate liability for all claims relating to the Service will not exceed the amount you paid for the App in the twelve months before the event giving rise to the claim, or USD 10 if you paid nothing.

These limitations do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or any other liability that applicable consumer law does not allow to be excluded.

10. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate the licence if you materially breach these Terms. On termination, the licence granted to you ends, but the sections that by their nature should survive — including intellectual property, disclaimers and limitation of liability — will continue to apply.

11. Governing law

These Terms are governed by the laws of the People's Republic of China, excluding its conflict-of-law rules. Subject to the paragraph below, disputes will be submitted to the courts of competent jurisdiction in Shenzhen, Guangdong, People's Republic of China.

If you are a consumer resident in the European Economic Area, the United Kingdom, Switzerland or another jurisdiction whose mandatory consumer-protection rules give you the right to bring proceedings in your local courts, nothing in these Terms affects those rights.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. If a change is material, we will provide a notice in the App or on this page before it takes effect. Continuing to use the App after the change means you accept the updated Terms.
